Welcome to EarlyBird ("we," "our," or "us"). By signing up for or using our website and SMS notification services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Overview of Service

EarlyBird provides automated notifications via SMS text messages regarding rental listings based on criteria submitted by users (such as location, price, bedroom count, and pet policies). We aggregate third-party real estate data to deliver automated updates.

2. Free Trial & Subscriptions

• Free Trial: New users may be granted a complimentary trial period (e.g., 24 hours) upon signing up. Free trials are limited to one per user/phone number. Updating your search criteria during an active trial does not extend or reset your original trial expiration time.
• Paid Subscriptions: Following the trial, continued access to real-time SMS alerts requires a paid subscription. Subscription fees are billed in advance and are non-refundable except where required by law.
• Cancellation: You may cancel your subscription at any time by following instructions provided on the platform or by replying STOP to any alert SMS.

3. SMS Notifications & Telecommunications

By providing your phone number to EarlyBird, you expressly consent to receive automated promotional and transactional text messages regarding rental listings.

• Message frequency depends on your saved search preferences and real estate market activity.
• Message and data rates may apply depending on your mobile carrier plan.
• To unsubscribe from text alerts at any time, reply STOP to any message.
• For help, reply HELP or contact our support team.

4. Accuracy of Listings & Disclaimers

EarlyBird acts solely as a notification aggregator and is not a real estate broker, landlord, or property manager.

• Third-Party Data: Listing details (pricing, availability, bedrooms, pet allowances, and specs) are retrieved from third-party sources and public feeds. We do not guarantee the accuracy, completeness, or timeliness of any listing.
• No Endorsement: Inclusion of a property in an alert does not constitute an endorsement, warranty, or guarantee of property condition or availability. Users are encouraged to verify all details directly with property managers or listing agents.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of local, state, or federal fair housing laws.
• Attempt to automatedly extract, scrape, or reverse-engineer any portion of the Service.
• Register multiple accounts using temporary or fraudulent phone numbers to artificially extend free trials.

6. Limitation of Liability

To the maximum extent permitted by applicable law, EarlyBird and its operators shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

• Your reliance on any listing information delivered through the Service.
• Inability to secure a rental property or missed rental opportunities.
• Service interruptions, SMS delivery delays, or network failure beyond our reasonable control.

7. Fair Housing Statement

EarlyBird supports equal housing opportunity. All rental listings made available through our Service are subject to the Federal Fair Housing Act, which makes it illegal to advertise any preference, limitation, or discrimination based on race, color, religion, sex, handicap, familial status, or national origin.

8. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service following published updates constitutes acceptance of the modified Terms.
